TERMS AND CONDITIONS

Tour Participation/Exclusions/Release: The operator reserves the right without payment or compensation to the participant, whether before or after the commencement of travel, to exclude any participant if in the opinion of the operator that participant may appear likely to endanger the health or safety or to impair the comfort of other participants and may be asked to leave the tour immediately.

Riding Experience: The Harry Redford Cattle Drive is suitable for people who can ride and riders must have a moderate level of fitness. For your own safety and the safety of others, please be honest about your riding ability. It is at the discretion of the Event Organiser and/or the Harry Redford Cattle Drive Committee to determine whether a rider is experienced and/or suitable to ride, based on the provision of horses for each rider. Riders must have had considerable riding exposure in order to be eligible to ride on the Harry Redford Cattle Drive. In the event that a rider is deemed to have had NOT enough experience in horse riding to participate in the Drive, the Event Organiser and/or the Harry Redford Cattle Drive Committee may at their discretion suggest that the participant be involved in a “non riding” capacity. The Event Organiser and/or the Harry Redford Cattle Drive Committee has the final decision on whether a rider has the ability to ride, based on the first priority of safety for the participants, the volunteers and the horses. Whilst the Event Organiser's will take every necessary precaution, all riders ride at their own risk. Horse and rider suitability is of the utmost importance and rider ability is paramount in the selection of suitable horse/rider combinations. If a participant has incorrectly advised the Harry Redford Cattle Drive Committee that they can ride, then the Event Organiser will, at their discretion refuse the allocation of a horse for that participant. The Event Organiser’s decision will be final and no discussion or correspondence will be entered into.

Age limit: Participants must be 18 years or older.

Health and Fitness: Rides include long days in the saddle covering distances between 10-18km per day. Ride participants should be in good physical condition and to follow the daily briefing instructions provided by the Boss Driver.

WARNING - Risks: The Harry Redford Cattle Drive is a recreational activity which involves physically demanding outdoor activities, including horse riding for extended periods of time over rough terrain and in close vicinity to horses and cattle en masse, camping and living in isolated outback areas in close vicinity to horses and cattle, potential interaction with dangerous native wildlife, and other rigorous activity. Although all reasonable care will be taken by the operator, participation in the cattle drive entails the risk of injury and damage suffered by a participant, and of consequential injury suffered by a dependent of a participant. Injuries to a participant can extend from sunstroke, dehydration, saddle sores to broken limbs, brain damage arising out of a head or other injury, paralysis and death. As the cattle drive route runs through isolated outback areas, there may be delays in emergency medical services attending an accident location and a participant receiving relevant medical treatment. Participants are required to sign a Warning, Disclaimer, Assumption of Risk, Release and Indemnity Form prior to being permitted to attend at and participate in the cattle drive.”

Changes to Itinerary: As these tours operate in remote areas, the Barcaldine Regional Council (hereinafter called the operator), reserves the right to alter, and/or cancel any section and/or parts of the itinerary which may result from road, weather or any other conditions of an operational nature. Whilst every endeavour will be made to keep the arrival/departure times and the campsite locations given in the itinerary, no guarantee will be made that these will be kept. The places depicted in the photographs and brochures are representative of the country through which tours pass and may not necessarily be visited by these tours. The highlights, excursions and itineraries as set out will be adhered to where possible. The operator or agent in charge of the tour, may make alterations to the itineraries and excursions highlights as they deem fit without any further notification to the participant. Information contained here is correct to the best of the operator’s knowledge, and the operator is not liable for inaccuracies herein, or weather conditions that may influence the limits of your tour and the enjoyment of your tour. If for any reason the itinerary is altered and/or different itinerary offered, no refund is payable by the operator.

Baggage: It is recommended that you bring a duffle style (soft) bag. Be aware of the red dirt conditions and that any luggage items you bring will be impacted by this dust and dirt.

Responsibility: The operator is not liable for any costs incurred by the participant through failure to connect with any other service. Any personal expenses incurred by the participant as a result of any delay, alteration or curtailment of the cattle drive (whether caused by weather conditions, mechanical defects or any other causes) are the responsibility of the participant.

The operator, its employees and agents are not responsible or liable for any act or omission by any of them (whether within or outside their control or by neglect or otherwise) for any booking, contract, travel, accommodation or tours which may result in any loss, damage, accident, detention, diversion or theft in regard to luggage or personal belongings.

Further, the operator, its employees and agents are not liable for any costs, expenses, loss, liability or damage arising out of personal injury or death, sickness, delay, inconvenience, or damage or loss to property, suffered or sustained by the participant directly or indirectly resulting from an event beyond the operator’s, or its employees’ or agents’ reasonable control including accident or failure of machinery or equipment, accommodation, transport or other services, or any acts of god, dangers or other natural occurrences in the outback, fire, acts of government, acts of war or other authorities, strikes or cancellation of itinerary or schedule changes.

Safety – horse riding helmet: Participants are required to wear a helmet whilst on horseback. Each participant will be supplied with a helmet (note: a participant may bring their own riding helmet to wear). The helmet is personal protective equipment provided for a participant’s safety with a view to minimising or reducing the harm a participant may suffer as a consequence of a horse riding accident. Failure to wear a helmet whilst horse riding may significantly increase the risk of harm occurring and the seriousness of a participant’s resultant injuries in the event of an accident. Further, failure to wear this appropriate safety equipment may void a participant’s private medical and/or travel insurance.

Travel Insurance: We strongly recommend that you purchase travel insurance (including cancellation insurance) to cover any unforeseen occurrences. Personal travel insurance is not included in the tour price. In booking your tour you acknowledge that personal travel insurance is your responsibility and that the Barcaldine Regional Council accepts no liability for any death, injury, sickness, damage or other loss whatsoever suffered by you.

Barcaldine Regional Council recommends that a participant seek advice from:

(a) their medical service providers, and private medical/travel insurer, to ascertain the consequences to their medical health, and to their medical/travel insurance, of not wearing appropriate safety equipment whilst undertaking the cattle drive; and

(b) their private medical/travel insurer regarding whether horseback riding, and participating in a cattle drive whilst on horseback, are activities included under their insurance policy. A participant may need to extend their insurance policy to cover these activities.”

Booking Conditions: All prices are in Australian dollars and are inclusive of Australian Goods and Services Tax. Please note that all reservations are subject to availability at the time of booking. Any verbal quote given is an estimate only of the price and tour and that will be subject to advice on confirmation of the reservation. If a booking is cancelled or terminated at any time the deposit is forfeited.

Deposits and Final Payments: All bookings will be processed via the Harry Redford Cattle Drive online booking system. A non-refundable/non-transferable deposit of 25% of total cost is payable at time of booking. Final payment is due 60 days prior to event commencement date, or the date listed on your online confirmation receipt – whichever comes first. For bookings made less than 60 days prior to departure date, full payment is required at time of booking.

Deposits: The required 25% deposit must be paid on booking. Full payment must be made 45 days prior to the event date.

Cancellation Fees: Bookings cancelled 45 days or more prior to the event will result in a loss of deposit. Any cancellations 45 days to the start of the event will result in a 50% cancellation fee.
